Terms of service
The rules for using TideLine and what you can expect from us.
Acceptance of terms
By creating an account, starting a trial, or subscribing to TideLine, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. Elite Analytics Inc. ('we', 'us', 'our') operates TideLine.
Service description
TideLine is a web-based forensic schedule analytics application for construction project controls and delay claims. Features vary by plan. We may update or remove features as the product evolves, and we will notify paying customers of material adverse changes.
Accounts and organizations
You must provide accurate information and keep your account secure. Organizations own the data created under the organization. Owners control membership, billing, and module access. Members act on behalf of the organization.
Subscriptions and billing
Subscriptions are billed in advance through Stripe. Prices are in the currency shown at checkout. You may upgrade, downgrade, or cancel through the Billing page or Stripe's hosted portal. Downgrades take effect at the next billing date; upgrades are usually prorated by Stripe. Cancellation stops future charges and access moves to read-only at period end.
Free trial
New organizations may start a 14-day free trial without a payment method. Trials include the modules shown during sign-up and may apply watermarks or usage limits. At trial end, access becomes read-only until a subscription is started.
Acceptable use
You may not reverse-engineer, scrape, resell, or use TideLine to process unlawful data. You may not attempt to bypass licensing, access another organization's data, or introduce malicious code. We may suspend accounts that violate these rules.
Data ownership and confidentiality
You retain ownership of the project files, schedules, and analysis inputs you upload. We do not sell your data. We access customer data only as needed to provide support, enforce security, or comply with law. See the Privacy Policy for details.
Intellectual property
TideLine, its code, designs, trademarks, and generated templates are owned by Elite Analytics Inc. You receive a limited, non-exclusive, non-transferable license to use the service during your subscription or trial.
Disclaimer and liability
TideLine is provided 'as is' without warranties of fitness for a particular purpose. We are not responsible for construction claim outcomes, legal advice, or decisions made using the tool. Our total liability is limited to the amount you paid in the 12 months before the claim.
Termination
Either party may terminate at any time by cancelling the subscription or closing the account. On termination, your data remains available in read-only form for a reasonable period, then may be deleted according to our retention practices.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes will be resolved in the courts of Toronto, Ontario.
Changes to these terms
We may update these terms from time to time. Material changes are announced in-app or by email. Continued use after changes constitutes acceptance.
